These Terms of Service ("Terms") govern your use of Rivalsee, a website monitoring and analytics service ("Service") operated by Second Coffee, LLC ("we," "us," or "our"). By accessing or using our Service, you agree to be bound by these Terms. If you disagree with any part of these terms, you may not access the Service.

2. Description of Service

Rivalsee provides website analysis services that:

• Analyze how your websites appear on AI-powered search engines (ChatGPT, Google AI, Perplexity, Claude, Grok)
• Generate analytics and insights about your online presence
• Allow you to customize analysis questions and parameters
• Provide reports and recommendations based on analytics and periodic website scraping

3. Account Registration and Security

Account Creation

• You must provide a valid email address to create an account
• You are responsible for maintaining the confidentiality of your account
• You must be at least 13 years old to use our Service
• You agree to provide accurate and complete information

Account Security

• We use magic code authentication via email or third-party authentication like Google Sign in
• You are responsible for all activities that occur under your account
• You must notify us immediately of any unauthorized use of your account

4. Subscription Plans and Payment

Free Plan

• Limited features as described on our pricing page
• All results are publicly accessible and may be indexed by search engines
• No payment required

Paid Plans

• Monthly or annual subscription via Stripe
• Features as described on our pricing page
• Results default to public but can be made private
• Price changes for existing customers require 30 days notice
• New customers may be subject to different pricing

Payment Terms

• All fees are in US dollars
• We offer a 7-day money-back guarantee on all paid plans. If you are not satisfied, contact us at support@rivalsee.com within 7 days of your initial payment for a full refund
• After 7 days, payments are non-refundable except as required by law
• You authorize us to charge your payment method on a recurring basis
• You are responsible for all taxes

5. Acceptable Use Policy

You agree NOT to:

• Use the Service for any illegal purpose or in violation of any laws
• Analyze websites you don't own without permission
• Scrape or analyze websites in violation of their terms of service
• Input personal information of others without consent
• Attempt to gain unauthorized access to our systems
• Interfere with or disrupt the Service
• Reverse engineer any aspect of the Service
• Resell or redistribute the Service without permission
• Use the Service to harass, abuse, or harm others
• Submit false or misleading information

6. Content and Intellectual Property

• You retain ownership of any content you submit
• You grant us a license to use your content to provide the Service
• You are responsible for ensuring you have rights to any content you submit
• For free accounts: You grant us the right to publicly display your results

Our Content

• The Service and its original content (excluding your content) are our property
• Our Service is protected by copyright, trademark, and other laws
• You may not copy, modify, distribute, sell, or lease any part of our Service

AI-Generated Content

• Analysis results are generated using third-party AI services
• We don't guarantee the accuracy of AI-generated content
• AI results reflect a snapshot in time and may change; you should independently verify important information

7. Privacy and Data Protection

Your use of our Service is also governed by our Privacy Policy. We use commercially reasonable efforts to protect your personal information and regularly review our practices. Please review our Privacy Policy for details on how we collect, use, and protect your data.

8. Third-Party Services

We are not responsible for the practices of these third-party services.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.

No Warranty

We do not warrant that:

• The Service will be uninterrupted or error-free
• The results will be accurate or reliable
• Any errors will be corrected

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

OUR TOTAL LIABILITY SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE PAST 12 MONTHS OR (B) $50.

10. Indemnification

You agree to defend, indemnify, and hold harmless Second Coffee, LLC and its officers, directors, employees, and agents from any claims, damages, obligations, losses, liabilities, costs, or expenses arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any third party rights

11. Termination

By You

You may terminate your account at any time by contacting us at support@rivalsee.com. If you cancel your paid plan within 7 days of initial purchase, you may be eligible for a full refund under our money-back guarantee.

By Us

We may terminate or suspend your account immediately, without prior notice, if:

• You breach these Terms
• We are required to do so by law
• We discontinue the Service

Effect of Termination

Upon termination:

• Your right to use the Service will immediately cease
• We may delete your data after 30 days
• All provisions that should survive termination will survive

12. Modifications to Service and Terms

Service Changes

We reserve the right to modify or discontinue the Service at any time without notice.

Terms Changes

We may modify these Terms at any time. If we make material changes, we will notify you by email or through the Service. Your continued use after changes constitutes acceptance of the new Terms.

These Terms and our Privacy Policy constitute the entire agreement between you and Rivalsee.

Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in effect.

Waiver

Our failure to enforce any right or provision will not be considered a waiver.

Assignment

We may assign or transfer these Terms; you may not assign or transfer your rights without our consent.

Public Nature of Free Account Data

By using a free account, you acknowledge and agree that:

• All analysis results are publicly accessible via a unique URL
• Results may be indexed by search engines
• We may include your results in our sitemap.xml
• You should not include any sensitive or personal information in your questions or descriptions
• If you upgrade to a paid account, you can make future results private, but previously public results may remain in search engine caches

Free services are provided without any warranty or guarantee of availability, and we may modify or discontinue free features at any time.
